According to learned counsel for the applicant, the present revision arises out of order passed by learned Sessions Judge, Akola in Criminal Appeal No.44 of 2011 dated 4.9.2014, by which appeal filed on behalf of the present appellant was dismissed in default.

Today, learned counsel makes a statement that after the present revision was admitted by this Court, the appellate court has already restored the appeal and it is fixed for final hearing on 28.6.2017. In that view of the matter, nothing survives in this revision. The same is disposed of.
