The Writ Petition No.6956/2017 (Yogita Marotrao Khope @ Yogita Manoj Wadkar Vs. State of Maharashtra and Ors.) decided on 05.04.2018 so also in Writ Petition No.635/2018 (Vijay s/o. Madhukar Wakode Vs. The Zilla Parishad, Akola and Ors.) decided on 06.12.2023, it is claimed in the present Civil Application that the identical issue including that of the one which is pleaded in the writ petition came to be decided. As such, Mr. Palshikar, learned Counsel appearing for the petitioner states that the present petition be also allowed in terms of the aforesaid orders. He would claim that the petitioner's services were transferred from Zilla Parishad, Yavatmal to Zilla Parishad, Akola, however, after putting in about a decade of service in Zilla Parishad, Akola abruptly the transfers are cancelled.

The learned Counsel appearing for the respondents states that the order cancelling the transfer is based on certain cogent reasons, however, if so directed, the respondents shall consider the claim of the petitioner.

In the aforesaid background, we are quite satisfied that the issue which is sought to be canvassed in the petition is similar to that of the issue which is decided in Writ Petition No.6956/2017 and Writ Petition No.635/2018 decided on 05.04.2018 and 06.12.2023 respectively.

That being so, we deem it appropriate to allow the present petition thereby quashing the impugned order dated 16.10.2017.
