By the present petition, the petitioner is seeking his premature release on account of his weakness in view of Govt. Resolution dated 10.1.2006 issued by the State Government. The petitioner is in jail since 17.6.2001 and he is directed to suffer rigorous imprisonment for ten years for the offence punishable under Section 304-I of Indian Penal Code.

The petitioner was presented before the Medical Board for examination and after examining the petitioner the Board has given its opinion that the petitioner is not a weak person. In that view of the matter, the petitioner is not entitled for the benefits under Govt. Resolution dated 10.1.2006 issued by the State Government. Petition dismissed. JUDGE JUDGE /TA/
