The petitioner has challenged the order of the Sub Divisional Officer imposing penalty in terms of Section 48(7) and (8) of the Maharashtra and Revenue Code, 1966 (MLR Code).

Alternate remedy to file appeal before Additional Collector in terms of Section 247 of the MLR Code is available.

In view of that, I am not inclined to entertain the petition. Therefore, the Writ Petition stands disposed of.

If appeal is filed by the petitioner before the Additional Collector within a period of two weeks from today, the said Authority shall endeavour to decide the same in accordance with law within a further period of four weeks.
