DATE : December 15, 2015 Rule heard finally with consent of counsel for the parties.

The petitioners are aggrieved by the order dated 10/12/2015 rejecting the application for cross examining two witnesses on whose behalf affidavits had been filed. The writ petition was heard yesterday for sometime and was kept today to enable Shri P. Kshirsagar, learned counsel for the respondent No.2 to take necessary instructions. Accordingly, the respondent No.2 has filed pursis on record which is marked as 'X' for identification in which it is stated that the respondent No.2 would not rely upon the evidence of Shri Vijay Ambhore and Shri Manoj Deshmukh. Statement accepted.

Accordingly, the respondent No.1 shall proceed to decide aforesaid proceedings ignoring said two affidavits and in the light of directions issued in W.P.No.5718 of

922-WP-6747-15 2/2 2015 in accordance with law.

Rule accordingly. No costs.
