Against an order dated 22.05.2024 passed by the respondent no.3Joint Registrar charging penalty and recovery of stamp duty, the petitioner preferred an appeal under Section 53(1)(A) of the Maharashtra Stamp Act, 1958, which is informed to be pending before the respondent no.2-The Inspector General of Registration and Controller of Stamp, Pune. It is informed that the said appeal is not heard since almost six moths.

It is claimed by the learned counsel for the petitioner that since filing of the appeal, he has moved applications before the respondent no.2 for expeditious disposal of the appeal, however, according to him, his request till date is not considered, which has prompted him to approach this Court.

In this background, we are of the view that we permit the petitioner to appear before the respondent no.2 on 28.01.2025. In case, if the petitioner appears before the respondent no.2- appellate authority, we expect the appellate authority to decide the appeal within a period of four months from the date of appearance of the petitioner before it. 5.
