Heard.

In respect of Crime No. 311/2015 registered at Sakkardara Police Station, District Nagpur for offence punishable under sections 302, 325 read with Section 34 of the Indian Penal Code, the applicant had surrendered to Police on 25.11.2015 and since then she is in jail.

Admittedly, there is no allegations about use of any instrument for making the assault on the deceased. Moreover, by this time, the investigation must have been completed.

Looking to the nature of the allegations, prima facie, in my opinion, the applicant would be entitled to be released on bail, particularly when she is a woman, aged about 27 years. Hence the following order:

ORDER

The applicant be released on bail on her executing personal bond in the sum of Rs. 20,000/-

27.01.ba.945.15 (Rupees twenty thousand) with one solvent surety in the like amount, with condition that she shall not tamper with the prosecution evidence.

Criminal Application (BA) No.945/2015 is allowed accordingly.
