Applicant is arrested on 07.10.2019 in connection with Crime No.479/2019 registered with Police Station Washim (City), Tq. Dist. Washim for an offence punishable under Sections 409, 411, 420 read with Section 34 of the Indian Penal Code.
As per prosecution story in nutshell, a crime was registered in the year 1997 i.e. Crime No.605/1997 in respect of stealing of Sandalwood, a forest produce. The said Sandalwood was worth Rs.7,00,000/- and after it is recovered, the said was kept in the storeroom of Forest Division Office. It was found that the said sandalwood got stolen from the said forest room. Therefore, discreet inquiry was conducted, in which it was found that one Ravi Rathod a clerk was having keys of the said storeroom. According to
ba1054.19.odt the reply, accused persons, including the present applicant, in collusion with Ravi, has caused disappearance of the said Sandalwood surreptitiously and sold the same to other coaccused persons. With this type of allegations against applicant, in my view, further custodial presence of the present applicant is not required. Hence, I pass the following order.
ORDER
(i) The application is allowed.
(ii) Applicant-Pradip s/o Uchit Gawai be released on bail in connection with Crime No.479/2019 registered with Police Station Washim (City), Tq. Dist. Washim for an offence punishable under Sections 409, 411, 420 read with Section 34 of the Indian Penal Code, on he executing P.R. Bond in the sum of Rs.25,000/- with one solvent surety in the like amount.
(iii) Applicant shall attend Police Station, Washim (City) thrice a week i.e. on every Thursday, Saturday and Sunday and shall be with the investigating officer from 11.00 a.m.to 05.00 p.m., till the charge-sheet is filed. The application is disposed of.
