Heard.

The applicant is arrested on 31st August, 2018 in connection with Crime No.946/2018 registered by the non-applicant for the offence punishable under Sections 363, 366, 376(2)(i)(j), 342, 506 of the Indian Penal Code and Section 4 of the Prevention of Children from Sexual Offences Act.

The F.I.R. is registered on the complaint lodged by victim, aged about 15 years and 8 months. According to the complainant / victim, the applicant is friend of her brother, on 28th August, 2018 he asked the victim to accompany him to the place where the crime is alleged to have been committed, she had gone with the applicant on 28th August, 2018 at about 6 p.m. and after committing the crime the applicant had kept her in a secluded room for the whole night, bolting the door of the room from outside and then next morning he

2 ba922.18 reached the applicant at her residence. According to the victim, she disclosed about the incident to her mother on 30th August, 2018 and complaint is lodged on 31st August, 2018.

The applicant, aged about 24 years, claims to be a businessman and has stated that he is not involved in any other crime / offence.

Though charge-sheet is not yet filed, the nonapplicant has not been able to point out that further custody of the applicant is required by it.

Considering the facts of the case, following order is passed:

The applicant having been arrested in connection with Crime No.946/2018 registered by the non-applicant, he be released on bail on executing P.R. bond for Rs.20,000/- and furnishing one solvent surety in the like amount.

The application is allowed in the above terms. JUDGE Tambaskar.
