Ms N. S. Pathan, Advocate for the applicant Mr M. R. Johrapurkar, Advocate for the non-applicant CORAM :

G.A. SANAP, J.

DATE :

JANUARY 25, 2023.

Heard learned Advocate for the parties. Perused the record and proceedings.

2.

By order dated 22.11.2022, while disposing of the Criminal Application No. 1130 of 2022 the order requesting the learned Judge to dispose of the Miscellaneous Case No. 2564 of 2014 within six months was passed by this Court. The said case has been filed by the present applicant. Perusal of the application indicates that the applicant, whose proceeding is pending before the Court, is not interested in speedy disposal of the matter. It is further

2 49.appp.2063.2022 seen that from the date of the order dated 22.11.2022, this Court has not received any request from the learned trial Court for extension of time for disposal of the matter. In my view, therefore, the reasons stated in the application cannot be considered. The application, therefore, deserves to be rejected. On going through the matter I am fully satisfied that the order passed by this Court requesting the learned Judge to dispose of the matter expeditiously is in the interest of the applicant. The application, therefore, stands rejected.

3.

It is made clear that in case the learned Judge is not able to dispose of the matter within stipulated time, he may make request and then this Court may consider the same appropriately.

The criminal application stands disposed of.
