This is an application, filed by the applicant/claimant for condonation of delay of 115 days in filing the appeal challenging the order passed by the Member, Railway Claims Tribunal, Nagpur Bench, Nagpur dismissing the appeal filed by the appellant for compensation, in respect of the death of her son in a railway accident. 2.

The respondent is duly served. I have requested Advocate Mr. Lambat, to appear on behalf of the respondent. The engagement of Advocate Mr. Lambat, be regularized by the respondent.

Mr. Lambat, learned Counsel for the respondent opposes the application for condonation of delay. 4.

For the reasons stated in the application and in view of the oral submissions made by the learned Counsel for the applicant, the delay deserves to be condoned. The application is allowed in terms of prayer clause (i). 5.
