The applicant is arrested on 5th April, 2018 in connection with Crime No.127/2018 registered by the non-applicant for the offence punishable under Sections 363, 364, 302, 201 of the Indian Penal Code. The F.I.R. is registered on the complaint lodged by father of victim. According to the investigating agency, the applicant and daughter of complainant had been classmates and the applicant used to express his feelings to the daughter of complainant, however, daughter of complainant avoided to give any response to the applicant. On 3rd April, 2018 the applicant called daughter of complainant on phone and threatened her that if she fails to respond to the proposal of the applicant, he would kidnap her younger brother, aged about 10 years, and kill him. On 4th April, 2018 minor

2 ba923.18 son of complainant, who was about 10 year old, had not returned from school, therefore, the complainant lodged complaint with the police. On suspicion, the applicant came to be arrested.

Learned A.P.P. has submitted that there is ample material available with the investigating agency which shows involvement of applicant in commission of crime. It is submitted that the C.D.R. also supports the claim of investigating agency that the crime is committed by the applicant.

Though the applicant is aged about 19 years and is a student, considering the facts of the case, I am not inclined to grant the prayer made in the application. The application is dismissed.
