The learned counsel appearing for the appellant submits that counsel for the respondent is expired. As the remedy under proviso to Section 372 of the Code of Criminal Procedure is available and in many matters the order of transfer is passed. The cases against acquittal were transferred to the concerned District and Sessions Court. For the reasons set out by this Court vide order dated 12.09.2025 in Criminal Application[APPA] No. 993/2024 in Criminal Appeal (ST) No.6644/2024 along with other matters, the matter is transferred to the concerned Court.

Needless to mention that the District and Sessions Court who will be dealing with the appeal, shall issue notice to the respondent and thereafter, proceed with the matter.

Appeal stands disposed of in above terms.
