Heard.

The applicant is arrested on 5th March, 2018 in connection with Crime No.74/2018 registered by the non-applicant for the offence punishable under Sections 395 and 120-B of the Indian Penal Code and Sections 3/25 and 4/25 of the Arms Act.

The crime is registered on the complaint lodged by the informant that about 4 persons forced their entry in the room of the lodge where the informant was sitting, the accused had gun and knife, the accused threatened the informant and took away Rs.2,84,000/- forcibly. Subsequently, according to the investigating agency, it was found that the robbery was of Rs.5,75,000/-.

The applicant, aged about 30 years, claims that he is doing the job of driver and that any other crime / offence is not registered against him. The

2 ba924.18 learned Advocate for the applicant has pointed out that co-accused Gurucharansingh and Balaji Waghmare are released on bail as per the orders passed by this Court. The investigation is complete and charge-sheet is filed. The non-applicant has not been able to point out that further custody of applicant is required by it. Considering the facts of the case, following order is passed:

The applicant having been arrested in connection with Crime No.74/2018 registered by the non-applicant, he be released on bail on furnishing cash security of Rs.50,000/- and two solvent sureties for Rs.25,000/- each.

The applicant shall attend the trial on every date unless granted exemption by the Sessions Court. The application is allowed in the above terms.
