Civil Application (CAF) No.4225 of 2019 The application has been filed for restoration of the appeal against respondent no.5 by setting aside the order of dismissal in default dated 15.10.2019. The respondent no.5 was directed to be served by paper publication and as the same was not forthcoming, appeal came to be dismissed on 15.10.2019. The learned counsel for the applicant submits that the paper publication was already done on 06.10.2019, however inadvertently the copies of the same were not placed on record.

Considering the above the appeal be restored. The order of the dismissal in default is set aside and appeal is restored. The Civil Application is disposed of.
