The challenge is to the order of disqualification passed by the respondent no.1 under provisions of Section-14(1)(j-iii) of the Maharashtra Village Panchayat Act, 1958. Admittedly the term for which the petitioner was elected has come to an end. A fresh election has been declared. In view of provisions of Section-16(1)(b) of the said Act, this disqualification operated for the term for which the petitioner was elected. As such term has come to an end, it is not necessary to adjudicate upon the controversy as regards correctness of the impugned order. Hence writ petition is disposed of in view of the fact that the term of the petitioner has come to an end. However the points raised in the petition are kept open. JUDGE Asmita
