Heard learned counsel for the applicant/respondent Nos. 1 and 2 as well as learned counsel for the appellant. Perused the application. The applicant/respondent Nos. 1 and 2 have prayed for withdrawal of the amount deposited by the appellant. After perusing the application and impugned judgment and award, I am of the view that 50% amount of compensation could be permitted to withdrawn by the applicant on usual undertaking.

Hence, I pass following order :-

ORDER

The applicants/respondents Nos. 1 and 2 are permitted to

8caf1761.18.odt 2 withdraw 50% amount of compensation deposited by the appellant in this Court on furnishing usual undertaking to the effect that in case appeal is allowed they will refund the amount to the appellant and remaining amount be kept in fixed deposit till the disposal of the appeal.

Civil application is disposed of.
