Chopde, Advocate for the petitioner. Shri A.A. Madiwale, A.G.P. for respondent Nos.1 and 10. Shri S.D. Chande, Advocate for respondent No.5. CORAM : RAVINDRA V. GHUGE, J.

DATED : 9.1.2020.

1] The petitioner is aggrieved by the order dated 25.5.2019 passed by the Divisional Commissioner, Amravati Division, Amravati. It is frankly stated that, as a statutory remedy was available, the petitioner has preferred an appeal before the State. Considering that State elections had taken place and the government was not formed and keeping in view the possibility of vacancy being declared which would mean fresh elections to elect a person in place of this petitioner, this petition was filed.

2] The learned A.G.P. appearing on behalf of the State submits that now the Ministry has been formed and the Minsters have been allocated their respective

2 wp7512.19 portfolios. The appeal preferred by the petitioner can now be dealt with by the concerned Minister.

3] Considering the above, this petition is disposed off. No costs.

4] The petitioner and the respondent Nos.2 to 9 shall appear before the Hon'ble Minister, Rural Development, on 10.2.2020 at 3 p.m. in his office in Mantralaya. Formal notices need not be issued. After the pleadings of the parties are completed and upon recording their oral submissions, the Hon'ble Minister would endeavour to decide the proceedings as expeditiously as possible and preferably on or before 30.4.2020.

5] The ad interim protection granted by this Court by the order dated 14.11.2019 would continue till 30.4.2020 or till the decision in the appeal preferred by the petitioner, whichever is earlier.
