JANUARY 19, 2016 Mr. Borkar, learned counsel for the applicant, attempts to demonstrate that invocation of Section 302 of the IPC is pending as, admittedly, no death has taken place in the present matter.

Learned A.P.P. is relying upon the reply to point out the circumstances in which the offence has been unearthed. He also invites our attention to the fact that Section 120-B of the IPC has been invoked in the present matter.

In this situation, as the investigation is still going on, we keep all the contentions of the applicant open with liberty to to approach again, after progress in the investigation.
