By this application, the applicant/appellant is seeking condonation of delay which is caused in preferring the appeal. The appellant has challenged the order of the Special Court, rejecting the regular bail of the appellant.

It is submitted by the learned counsel for the appellant that as the appellant is behind bar, he could not manage and arrange for his defence. Therefore, delay is caused.

Considering the reasons mentioned in the application, application is allowed delay of 172 days is condoned.

Criminal application is disposed of.
