We do not see any mala fides. Hence, the order dated 3rd November 2017, is recalled.

Only to find out prima facie merit, we have heard Adv. Samarth. On basis of rejoinder, he states that very same Oil Company has, while advertising location at Kalmeshwar, issued dealership to establishment at Bamni where petitioner's land is situated.

Hence, issue notice after restoration to respondents. 5.

We find that Adv.Abhay Sambre was already appearing for respondent no.2. As such, notice can be served upon Adv. Sambre.

Stand over after two weeks.

Till then, status quo as on today.
