In the wake of orders dated 10.02.2016, as charge-sheet is filed, upon instructions Shri Naik, learned Counsel for applicants seeks leave to withdraw the present proceedings with liberty to file appropriate application before the trial court, keeping all contentions open.

Learned Counsel appearing for the respondent no.2 has no objection.

Learned A.P.P. submits that as charge sheet is filed, invocation of extra ordinary jurisdiction is not proper.

We do not wish to comment on merits of the controversy. Keeping all rival contentions open and with liberty to applicants to take appropriate steps before the trial Court, we dispose of the present application. No costs.
