After having heard at length, when this Court was not inclined to grant the relief, the learned counsel for the applicant on instructions seeks permission to withdraw the application with liberty to apply afresh before the learned trial Court once material witnesses are examined.

The permission is granted. The criminal application is dismissed as withdrawn with liberty as prayed for.

At this stage, the learned counsel for the applicant submits that material witnesses have already been examined. However, it is made clear that the trial Court would decide whether the material witnesses have been examined and accordingly would deal with the application.
