Sandip S/O. Vishwalochan Jaini (In Jail) v. State Of Maharashtra Thr. Police Station Officer Police Station Hudkeshwar Nagpur Dist. Nagpur
IN THE HIGH COURT OF JUDICATURE AT BOMBAY,
NAGPUR BENCH : NAGPUR Criminal Application (APPP) No. 1714 of 2018 In Criminal Application (BA) No. 75 of 2018 Sandip v. State of Maharashtra Shri A. V. Bhide, Advocate for applicant Shri K. L. Dharmadhikari, APP for respondent Coram : S. B. Shukre, J Dated : 16th October 2018 P.C.
Heard.
While granting bail to the applicant on 8.3.2018, this Court imposed several conditions on the applicant. There was one condition which says that the applicant would attend the Police Station every Sunday between 10.00 am and 12.00 noon till filing of the charge-sheet. This condition was in operation only till filing of the charge-sheet and if charge-sheet has been filed, there would be no need for the applicant to attend the Police Station every Sunday. But, the circumstances are very peculiar in this case. They indicate that the applicant himself added to his difficulty. Applicant states that the condition regarding attendance on every Sunday should not be relaxed by stipulating that instead of every Sunday, it should be something like a fortnight or a month.
I am not inclined to accept the prayer made in this application. The reason being that the applicant himself obtained stay from the Division Bench of this Court on filing of the charge-sheet. This was after the applicant knew that if he obtained stay on these lines, it would only add to his difficulties. But, the applicant did
obtain stay. That was a matter of choice for the applicant and now that he has chosen to increase his difficulties, it is only him who has to help himself. In this view of the matter, I am not inclined to allow the application. Application is rejected.
