The applicant has apprehension of arrest in Crime No.387/2025 registered at Police Station, Pusad City, District Yavatmal for the offences punishable under Sections 109(1), 3(5) of the Bharatiya Nyaya Sanhita, 2023.

It is alleged that the applicant along with other two co-accused assaulted the injured when he was sitting in his auto. The eye witness is the sister of the injured. She has stated that she saw two persons came on the motorcycle and they assaulted her brother. The injured in his statement stated that two persons came there, the applicant was standing there and he asked them to kill him.

The learned Counsel for the applicant has stated that two other co-accused are already released on bail. There is no allegations against this applicant. The eye witness has not mentioned the name of this applicant. Though the injured has stated about his presence, no act is attributed to this applicant. Hence, prayed to confirm the interim protection granted by this Court on 17.10.2025.

The learned A.P.P. opposed the application stating that the C.C.T.V. footage shows that three assailants came there and they assaulted the injured. The antecedents are there. The injured has taken the name of this applicant. Similar type of crimes are registered against this applicant. Hence, prayed to reject the application.

Heard the learned Counsel for the applicant and the learned A.P.P. for the State.

Though the injured has mentioned the name of this applicant, no role is attributed to this applicant by the injured. The eye witness has not mentioned the presence of this applicant. As the other co-accused are already released on bail, the custodial interrogation of this applicant is not required. Hence, the interim protection granted on 17.10.2025 is confirmed on the same terms and conditions.
