This is an application for condonation of delay of 2290 days in preferring the cross-objection by the original claimants in the appeal preferred by the acquiring body under the Land Acquisition Act,1894.

The learned counsel appearing for the applicants submits that sufficient grounds are made in the application, hence, the same be allowed.

The learned counsel for the acquiring body would submit that there is exorbitant delay in filing the application Kavita

2 / 2 35-cao 1322-25 and no plausible explanation is given in the application and the same be rejected.

The appeal preferred by the acquiring body is already admitted. The original claimants have preferred the cross-objection along with this application for condonation of delay. On going through averments in the application and after hearing both the sides, the following order is passed.

ORDER

(i) The Civil Application is allowed in terms of it's prayer clause (a).

(ii) The applicants shall not be entitled for the interest on the statutory benefits for the delayed period. The applicants shall give necessary undertaking before the Registrar of this Court in that regard.

(iii) Civil Application stands disposed of. JUDGE Kavita
