DATE : October 12, 2018 As eviction of the appellants has been sought under provisions of the Maharashtra Rent Control Act, 1999, the Second Appeal would not be maintainable in view of provisions of Section 34 of the said Act.

In view thereof the learned counsel for the appellant is permitted to withdraw the Second Appeal with liberty to file appropriate proceedings. As the appellants have been directed to hand over possession of the suit premises within period of thirty days from 10/09/2018, their possession shall remain protected till 23/10/2018.
