IN THE HIGH COURT OF JUDICATURE AT BOMBAY

NAGPUR BENCH : NAGPUR CRIMINAL WRIT PETITION NO.1062 OF 2014 (Mohd. Yakub Abdul Majid Nagul vs. Deputy Inspector General (Prisons)(East) and others) __________________________________________________________________ Office Notes, Office Memoranda of Coram, appearances, Court's orders Court's or Judge's orders or directions and Registrar's orders.

Shri M.N. Ali, Advocate for petitioner.

Shri V.A. Thakare, Additional Public Prosecutor for respondents.

---------- CORAM : A.B. CHAUDHARI AND P.N. DESHMUKH, JJ.

DATED : MARCH 3, 2015 The petitioner has approached this Court being aggrieved by rejection of his application for furlough by impugned order dated 9.12.2014 passed by respondent no.1.

Heard learned Counsel for the parties and perused the affidavit-in-reply filed by respondents. It is revealed that petitioner is convicted for having involved in serious offences in Mumbai Railway

0303WP1062.14 2/2 Bomb Blast Case and is undergoing life imprisonment for the offence punishable under Section 302 of Indian Penal Code.

The application of petitioner for grant of furlough has been rejected by respondent no.1 as petitioner had failed to surrender on due date and also on the ground that petitioner came to be convicted in Mumbai Railway Bomb Blast Case for serious offences. The competent Authority did not find it fit to release the petitioner on furlough.

Considering the above facts, we do not find any reason to interfere with the impugned order. The criminal writ petition is, therefore, rejected.
