IN THE COURT OF JUDICATURE AT BOMBAY
NAGPUR BENCH, NAGPUR WRIT PETITION NO.6990/2016 (The Headmaster, Thakurs Green Valley School Nagpur and another vs. The State of Maharashtra and another ) .............................................................................................................................................. Office Notes, Office Memoranda of Coram, appearances, Court's orders Court's or Judge's order of directions and Registrar's orders .............................................................................................................................................. Mr. N.A. Jachak, Advocate for the petitioners Mr. A.M. Balpande, Asst. Govt. Pleader for respondents 1 and 2 CORAM : SMT. VASANTI A. NAIK & MRS. SWAPNA JOSHI, JJ.
DATED : 15th December, 2016.
Heard.
The only prayer made by the petitioners in the instant petition is for a direction against the respondent-Education Officer (Secondary) to grant approval to the appointment of the petitioner no.2 on the post of Assistant Teacher as the petitioner no.2 has satisfactorily completed three years of services as a Shikshan Sevak.
Shri Jachak, the learned counsel for the petitioners states that though the petitioner no.2 has satisfactorily completed three years services as a Shikshan Sevak in August 2016 and a proposal for grant of approval to the petitioner no.2 as Assistant Teacher is submitted to the Education Officer, the Education officer is not taking an action on the said proposal. It is stated that in the absence of approval, the petitioner no.2 is not in a position to secure the salary from the State Exchequer though she is entitled to the same.
15.12.wp.6990.16 Since the prayer made on behalf of the petitioners is innocuous, we dispose of the Writ Petition, with a direction against the Education Officer to decide the proposal in respect of the petitioner no.2, within a period of three weeks. Order accordingly. No costs.
