The present matter revolves around the question whether the respondent is entitled to extend the benefit of family pension to the widowed daughter of the deceased employee.

There is no dispute about the fact that the petitioners' employee, the respondent's father died in the year 2004, thereupon, his widow received family pension up to her death till 2018. It is also not in dispute that the respondent is the widowed daughter of the above referred deceased employee.

As per the policy of the petitioners, a widowed daughter is also entitled to receive family pension. However, in the present case, such benefit has been denied on the ground that her husband had deserted her, and that nd.thawre

2/2 she had not applied for appointment on compassionate grounds.

The petitioners do not dispute that the respondent is the widowed daughter of the deceased employee and that there has been no separation or dissolution of her marriage before the death of her husband.

In the circumstances, the grounds on which the pension has been denied was considered by the tribunal as not tenable in the eyes of law. We do not find any perversity in the same and accordingly, the writ petition is dismissed.
