NO. 2870/2022 The civil application is filed under Order V Rule 20 of the C.P.C., 1908 for subsituted service upon R.No. 5 by way of paper publication. It is averred that, as per the bailiff's report, the notice received back unserved for want of detailed address. It is further stated that the appellant company had taken all efforts to get information about the change address but could not get information about the change address of aforesaid respondent.

Hence, considering the reasons mentioned in the application and the bailiff's report, the applicant is allowed to serve aforesaid respondent by substituted service on the last known address by paper publication.

Substituted service be effected upon aforesaid R.No. 5 by publishing a notice in widely circulated local daily newspaper "Dainik Bhaskar Nagpur Edition" in terms of Order V Rule 20 (1-A) and 20(1) of C.P.C. by affixing copy of notice on some conspicuous part of the house where the respondent lastly known to have resided, returnable within four weeks from the date of publication of notice.

6. It is averred that notice issued to the aforesaid respondent received back unserved with remark that noticee is not residing on the given address. Thus, the applicant is furnishing correct address of aforesaid respondent.

Since the application is formal in nature, the same is allowed. Necessary amendments be carried out in the cause title of the matter. Thereafter, upon supply of copy, office to issue notice to the aforesaid respondent, returnable within four weeks.
