Heard Shri Y.B. Mandpe, learned counsel for the applicant, Shri V.P. Maldhure, learned APP for nonapplicant No. 1 and Shri M.N. Potbhare, learned counsel for non-applicant No. 2.
The complaint, leading to the FIR under Sections 363 and 366 of Indian Penal Code was lodged by one Charan Gajbhiye. He alleged that his daughter was victim. That daughter is non-applicant No. 2 in present matter. It appear that Charan Gajbhiye has expired.
In this situation, when the matter came up before this Court for compromise on 15.12.2016, we directed the parties to keep mother of non-applicant No. 2 i.e. wife of Charan Gajbhiye present. Accordingly, Smt. Aruna Charan Gajbhiye is present before this Court. She states that her daughter is married to Prakash @ Pappu Dharmaji Raut and residing with him. She also informs that her daughter is regularly visiting her. The residence of mother is at Nagpur.
In view of these developments, as we find
2112apl822.16 that the applicant and non-applicant No. 2 are married happily and two sons are also born to them, we make the rule absolute in terms of prayer clause (i). The affidavit tendered by Shri Potbhare, learned counsel on behalf of Smt. Aruna Charan Gajbhiye is taken on record.
Criminal Application is disposed of accordingly. No costs.
