DATED : DECEMBER 12, 2019 Mr. Gandhi, learned counsel for applicant submits that this is the third bail application filed by the applicant. His two bail applications were rejected by this Court after considering material against the applicant in the charge-sheet. He submits that trial has commenced and, in fact, 3 witnesses are already examined. According to him, there are total 29 witnesses cited by the prosecution. He submits that if the Court is not inclined to grant bail, the trial may be expedited. Two different Coram of this Court have already considered the applicant's application on its own merits and it was found that the applicant is involved in one of the serious crimes which is facing and therefore the application be rejected as there is no change in the circumstance.

Learned counsel for the applicant submits since the Court is not inclined to grant bail, he is withdrawing the application.

ba1062.19.odt Since learned counsel for applicant is withdrawing the application, the Court is not giving reasons as to why the application is being rejected. However, since the applicant is in jail since 20.11.2017, he has every right to get his trial decided expeditiously In that view of the matter, I pass the following order:

ORDER

(i) The application is dismissed as withdrawn.

(ii) The learned Additional Sessions Judge, Mehekar, District Buldana shall decide Special Case No.165/2019 (Old No.05/2018) within a period of one year from the date of receipt of this order. It is expected that the applicant will extend full cooperation to the learned Judge of the Court below for early disposal of the trial.

The application is disposed of.
