DATE : 11.12.2025 Learned counsel for the applicant states that on the basis of the order of temporary injunction which is impugned in the present appeal, the respondent/original plaintiff is blocking the access of the appellant/original defendant to his portion in land bearing Gut Nos.166 and 167.

Learned counsel for the applicant further states that the purpose of the appeal will be served, if it is clarified that the respondent/plaintiff cannot obstruct the access of the defendants to land bearing Gut Nos.166 and 167.

The scope of the present appeal is restricted to the correctness or otherwise of the order of temporary injunction dated 24.08.2023. If the plaintiff is creating any nuisance on the basis of the said order, it will be open for the defendants avail appropriate remedy including to move appropriate application before the learned trial Court, including an application for grant of temporary injunction which may be filed either under Section 94 read with Order 39 or Section 151 of the Code of Civil Procedure.

The appeal is accordingly disposed of with liberty as prayed.
