The first prayer made in the application cannot be granted. The judgment in the case of Apoorva Nichale, reported in 2010(6) Mh.L.J. 401 is challenged before the Hon'ble Supreme Court and the special leave petition is pending. Though we reject the first prayer made in the civil application, since the learned counsel for the applicant states that in the circumstances of the case, it would be necessary to remand the matter to the scrutiny committee, we direct the office to list the matter for final hearing in the week commencing 23rd of January, 2017.
The civil application stands disposed of accordingly.
