St. No. 11113/2017 Coram : Registrar(Judicial) Dated : 30.10.2018 The Counsel for the applicant has filed application for deleting the name of respondent no.6 from the record. It is stated in the application that the notice issued to the respondent no.6 came to be returned back unserved as the said respondent is reported to be dead. Since all the legal heirs i.e respondent nos.1 to 5 are already on record, the applicant has requested to delete the name of the respondent no.6 from the array of the respondents in the appeal as well as in the application for condonation of delay and stay. Considering that since all the legal heirs of the respondent are already on record and the application is supported by affidavit, the same is allowed and the name of the respondent no.6 is deleted at the risk of the applicant/appellant. Necessary amendment be carried out in the cause title of the Appeal Memo.
