CORAM
: B.P. DHARMADHIKARI & V.M.DESHPANDE, JJ.
DATE : FEBRUARY 11, 2016.
Heard Shri R.M. Khapekar, learned Counsel for the petitioner and Shri Ahirkar, learned A.P.P. for respondents.
2.
We find that offence under Section 304 of Indian Penal Code is already added and is being investigated into.
3.
The insistence of petitioner for a direction to re-arrest, is unwarranted, as learned A.P.P. has pointed out that the section was already there. 4.
We therefore, find that the challenge is rendered infructuous. Criminal Writ Petition is accordingly disposed of. No costs.
