The petitioner's challenge is to the order dated 29.09.2025 passed by the Sub-Divisional Officer, Akot vacating interim stay which was granted on the same day.

The counsel for the petitioner states that the interim stay was granted after considering the judgment and decree passed by the trial Court and appellate Court in the controversy between the same parties which was pointed out to the Sub-Divisional Officer, however, on the same day, the stay is vacated. He submits that the appeal before the Sub-Divisional Officer is now fixed for 13.10.2025 for final hearing.

Considering the fact that the instant petition raises challenge only to the order vacating stay and considering the fact that the main appeal is fixed for final arguments on 13.10.2025, the instant writ petition is not entertained. However, the respondent no.3-SubDivisional Officer, Akot is directed to expeditiously decide the pending appeal after conducting final hearing on 13.10.2025, within a period of one week thereafter.
