By this application, the respondent No.1/claimant is seeking withdrawal of the amount of Rs.3,41,281/- which is deposited by the appellant against the decree and accrued interest on it.

The appellant has strong objection for withdrawal, on the ground that the Reference Court has awarded the compensation at a higher rate.

Heard both the sides.

Considering the reasons mentioned in the application, the applicant/respondent No.1 is permitted to withdraw 75% of the amount which is deposited by the appellant, on furnishing usual undertaking.

Civil application is disposed of.
