The petitioner has approached this court against the order of the Tahsildar, Hingna, issued in pursuance of the order passed by the learned District Magistrate under Section 14 of the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 with the limited request for grant of interim relief solely on the ground that the Debts Recovery Tribunal, Nagpur is not functioning in the absence of the Presiding Officer. Mrs.Tiwari, the learned Assistant Government Pleader states on instructions that the charge of the Debts Recovery Tribunal, Nagpur is with Debts Recovery Tribunal-III, Mumbai at present and though the Presiding Officer, Debts Recovery Tribunal-III, Mumbai would retire on 13/12/2016, by that time, the Presiding Officer, Debts Recovery Tribunal, Nagpur would resume his duties. In view of the statement made by the learned Assistant Government Pleader on instructions, we are not inclined to entertain the writ petition. The writ petition is disposed of with no order as to costs.
