Considering the nature of direction proposed to be issued, it is not necessary to issue notice to respondent Nos.2 and 3. Rule. Rule made returnable forthwith and heard the learned counsel for the petitioner and the learned Assistant Government Pleader for respondent No.1.

The father of the petitioner was serving as a Peon at the respondent No.3 School which is run by respondent No.2Society. The petitioner's father died in harness and hence the petitioner is desirous of seeking his appointment on compassionate basis. On 11/06/2018 the petitioner made an application seeking his appointment on compassionate basis to the respondent No.1. By its communication dated 10/01/2017

16-WP-7875-19 2/2 the respondent No.3 sought permission of the Education Officer to make such appointment. There has however been no response to the aforesaid.

The interests of justice would be served by directing the Education Officer (Secondary) to consider the application submitted by the petitioner on 11/06/2018 and by the respondent No.3 on 10/01/2017 on its own merits and take a decision thereon. The same be done within a period of four weeks from production of this order by the petitioner before the Education Officer. The decision taken be communicated to the petitioner.

Rule is disposed of in aforesaid terms with no order as to costs.
