By preferring this application, the applicant is seeking bail.

I have heard learned Counsel for the applicant to some extent. Perused the investigation papers from which it reveals that the death of the deceased is due to the haemorrhagic shock due to head injury leading him cardio respiratory arrest and death. As far as the role of the present applicant which is assigned by the sole eye-witness that present applicant has pressed the neck of the deceased which is substantiated by the medical report i.e. the postmortem report which shows the injury on both sides of the neck, therefore, I have shown my disinclination to grant bail to the applicant. 4.

In view of that, learned Counsel for the applicant seeks permission to withdraw the application.

The application is disposed of as withdrawn.

Considering the fact that the applicant is arrested on 03/07/2021 and since then he is behind bar, the trial Court shall expedite the trial and shall dispose it of at the earliest.
