DATE : 21.11.2018 Heard Shri Mahesh Rai, learned counsel for the applicant. He has submitted that the victim has not stated specific name of the applicant. After enquiry by his mother, he has submitted that one unknown person came to him and has taken him in the forest and did unnatural act. Therefore, the applicant has falsely implicated in the crime. He thus prayed to grant him bail.
Shri C.A.Lokhande, learned APP has submitted that earlier application of the applicant came to be rejected and his subsequent application also came to be rejected since there is no change in circumstances. Learned APP has further submitted that the applicant has already withdrawn his earlier bail application before this Court and therefore, the application is liable to be rejected. From the perusal of the order, it appears that this Court was not inclined to grant bail and therefore, the counsel for the applicant has withdrawn Criminal Application (BA) No.101/2018. Two successive bail applications of the applicant came to be rejected by the trial Court. The third application moved by the applicant came to be rejected on 26th July, 2018, holding that there is no change in the circumstances. The trial is already commenced against the applicant.
BA929.18 2/2 Looking to this situation, it will not be appropriate to release the application on bail. Hence, the following order.
ORDER
(i) The application is rejected.
(ii) The trial Court is directed to expedite the trial and decide the same within a period of six months from today. JUDGE Andurkar
