Having heard both the sides for quite some time, learned counsel for the applicant submits that the purpose of filing of the application will be served for the time being if the investigating agency is directed to proceed with the investigation but strictly in terms of the law laid down in Arnesh Kumar Vs. State of Bihar, 1 and Satender Kumar Antil Vs. Central Bureau of Investigation and another 2 .

As such, the investigating agency is bound by the law laid down by the Apex Court in the aforesaid judgment. However, the investigating agency is directed to strictly proceed with the investigation, in accordance with the law laid down in the aforesaid case.
