ORDER
(Passed on 13th July, 2019) 1] The parties with their counsel state that they have settled the claim and the terms of compromise have been placed in writing which is marked as "X" for identification. Respondent no. 3 - Vaibhav S/o Raju Nagdeve is present as a power of attorney on behalf of respondent no. 5 - Vatsalabai Wd/o Sadashiv Nagdev, which is marked as 'Y' for identification.
2] Parties have amicably settled the matter and it is agreed that the appellant would pay Rs. 3,25,000/- to the claimants towards full and final settlement. Out of the amount of Rs. 3,25,000/-, the appellant is ready to deposit Rs. 75,000/- with High Court, Nagpur within one month from today. The appellant has already deposited Rs. 25,000/- in the High Court, Nagpur. It is stated that the remaining amount of Rs. 2,25,000/- will be deposited by the appellant within 6 months from today. 3] After deposit of Rs. 75,000/-, the claimants will be at liberty to withdraw the amount of Rs. 1,00,000/-, and the claimants can withdraw the remaining amount of Rs. 2,25,000/- after it is deposited with High Court, Nagpur alongwith accrued interest.
4] Court fee, if any, be refunded to the appellant as per the Rules. 5] There is no reason to refuse this compromise. Hence, the matter stands disposed of in terms of compromise Pursis 'X'.
