Heard learned counsel for respondents.

The petitioners challenge the order dated 09.07.2018 passed in Arbitration Case No.36/ARB/2016-17 by the Additional Commissioner, Nagpur and Arbitrator under National Highways Act, 1956.

Learned counsel for the respondent No.3 raised an objection on the ground that the alternate and equally efficacious remedy under Section 34(3) of the Arbitration and Conciliation Act, 1996, is available for the petitioners. 4.

In view thereof, as the petitioners are having alternate remedy under Section 34(3) of the Arbitration and Conciliation Act, 1996, the present petition is disposed of as not maintainable.

The petitioners may avail the remedy as is permissible under the law.
