Mr. Thombare, learned counsel for the petitioners submits, that so far as payment of regular pension is concerned, the petitioners are receiving the same and there is no dispute on that count. The only question now remains is the payment of gratuity, commutation of pension and the leave encashment. The learned counsel for the respondent nos.2 and 3 has tendered across the bar Government Resolution dated 9th August, 2024, in terms of which, the State has undertaken the liability to pay the pensionary benefits of the respondent no.2 and 3 - employees. The Government Resolution dated 9th August, 2024, is taken on record and marked as "X" for the purpose

2 8-510-23.odt identification. The names of all five petitioners are included in the said Government Resolution, in view of which, the grievance of the petitioners stands redressed so far as the above claims are concerned. 2.

The learned Assistant Government Pleader makes a statement, that the disbursement shall be done within one month from today. The statement is accepted.

Insofar as interest is concerned, as the petitioners have approached the Court with substantial delay, they will be entitled to interest upon the aforesaid amount only from the date of filing of the petition, till 3rd October, 2024, within which time, the respondent / State assures to make the payments.

The petition is disposed of in the above terms. No costs.
