NAGPUR BENCH : NAGPUR CONTEMPT PETITION NO. 4 OF 2016 IN WRIT PETITION NO.482 OF 2015 (Sanjay s/o Ambadas Jain and others vs. The State of Maharashtra and another) __________________________________________________________________ Office Notes, Office Memoranda of Coram, appearances, Court's orders Court's or Judge's orders or directions and Registrar's orders.
CORAM : B.P. DHARMADHIKARI AND P.N. DESHMUKH, JJ.
DATED : MARCH 7, 2016 Adv. Kothari informs that Adv. Raut appearing for petitioners is not available and, therefore, he is seeking adjournment.
Shri Lonare, learned Assistant Government Pleader for respondent no.1 and Smt. Dangre, learned Counsel for respondent no.2, however, point out that decision in terms of order dated 5/5/2015 passed by this Court in Writ Petition No. 482/2015 has already been taken and hence, directions are complied with.
Copy of Government Resolution dated 25/2/2016 notifying lapsing of reservation in terms of Section 127(2) of the Maharashtra Regional and Town Planning Act (Marathi and English both) is placed on record. It is marked as Exh. `X'. Its copy
0703cp4.16 2/2 is also made available to Adv. Kothari.
We have perused order dated 5/5/2015 in Writ Petition No. 482/2015 as also Government Resolution dated 25/2/2016. We find that there is already a notification of de-reservation. Thus, order dated 5/5/2015 passed by this Court has been complied with.
Adv. Kothari attempts to urge that compliance is not within time and hence, there is contempt.
We do not wish to go into the said aspect in this matter. We accordingly dispose of the contempt petition. No costs.
