DATE : 15.2.2016 Heard Shri S.V. Sirpurkar, advocate for the applicant and Shri M.J. Khan, A.P.P. for the non-applicant.

The applicant is arrested in connection with crime registered by the non-applicant for the offences punishable under Sections 498-A, 302, 304-B read with 34 of the Indian Penal Code. The F.I.R. is registered on the basis of alleged dying declaration of deceased Sonali (wife of the present applicant) against the applicant, father of applicant, mother of applicant and sister of applicant. The father, mother and sister of applicant are released on bail. The charge-sheet is filed on 19 th August, 2015. The applicant

2 ba965.15 had been working as Teacher in school administered by Zilla Parishad. The non-applicant has not been able to show that the custody of applicant is required for further investigation. In the above facts, I am inclined to grant prayer of the applicant. Hence, the following order :

The applicant having been arrested in Crime No.119/2015 for the offences punishable under Sections 498-A, 302, 304-B read with 34 of the Indian Penal Code be released on bail on furnishing P.R. bond in the sum of Rs.50,000/- and two solvent sureties in the like amount. Out of two solvent sureties, one solvent surety shall be furnished by resident of Goyanka Nagar, Murtizapur, Distt. Akola. The applicant shall attend every date of sessions trial before the Sessions Court unless he is granted exemption by the Sessions Court. In default on the part of the applicant to attend any date of trial before the Sessions Court, without seeking exemption from the Sessions Court, this order shall stand recalled. The application is allowed in the above terms. In the circumstances, the parties to bear their own costs.
