and Registrar's Orders.

--------------------------------------------------------------------------------------------------------------------------------- Shri A.D. Ramteke, Advocate for Petitioner.

Shri Daruwala, Advocate for Respondent.

CORAM: ROHIT B. DEO, J.

DATE: 6 th MARCH, 2018.

The learned counsel for the petitioner-wife seeks permission to withdraw the petition which assails an order refusing to award interim maintenance. However, the learned counsel for the petitioner further submits that it would be just and fair if the learned Judge of the Family Court is directed to finally dispose of the proceedings in a time bound manner. The request is fair. Shri Daruwala, the learned counsel appearing for the respondent-husband has no objection if the petition-case E 304/2016 pending before the Judge, Family Court is decided in a time bound manner. 2] The petitioner is permitted to withdraw the petition unconditionally.

3] However, the learned Judge, Family Court is requested to finally dispose of petition-case E 304/2016 as expeditiously as possible and in any event within six months

cwp1051.17.O.odt 2 from the date of this order.

4] With this observation the petition is disposed of as withdrawn.
